1. Introduction

Welcome to AI Academy ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website (aiacademyos.com) and the educational content, digital tools, and services provided therein (collectively, the "Services").

By purchasing our products or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Merchant of Record & Payments

Our order process is conducted by our online reseller, Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders.

• Role: When you purchase a course or subscription, your contractual relationship for the payment and delivery of goods is with Lemon Squeezy.
• Terms: Purchases are subject to Lemon Squeezy's Terms of Service and Privacy Policy.
• Taxes: Lemon Squeezy is responsible for collecting and remitting applicable taxes (VAT, GST, sales tax) based on your location.

3. Digital Products & Right of Withdrawal

Our Services consist of digital content (e.g., video courses, templates, access to platforms) that is not supplied on a tangible medium.

For customers in the EU, UK, and Serbia: By clicking "Buy," "Purchase," or "Subscribe" at checkout, you expressly consent to the immediate performance of the contract (immediate access to the digital content) and acknowledge that you thereby lose your right of withdrawal (right to a refund) once the download or streaming has begun.

Refund Policy: Due to the digital nature of our products, all sales are final once access has been granted. Exceptions are made only in accordance with the refund policies of our Merchant of Record (Lemon Squeezy) or mandatory local laws regarding defective content.

4. License and Intellectual Property

Upon purchase, we grant you a limited, non-exclusive, non-transferable, and revocable license to access the materials for your personal, non-commercial educational use.

• No Sharing: You may not share your login credentials with others.
• No Resale: You may not reproduce, redistribute, resell, or publicly display any content from our platform.
• Ownership: All content (text, videos, code, branding) remains the intellectual property of AI Academy.

5. AI Content Disclaimer

Portions of the educational content and materials provided through the Services are generated with the assistance of Artificial Intelligence (AI) technologies (e.g., ChatGPT).

• No Guarantee of Accuracy: While we review materials for quality, AI can produce incorrect or misleading information. You acknowledge that the content is provided for educational purposes only and should be verified independently before making any decisions based on it.
• Third-Party Availability: We do not guarantee uninterrupted access to AI-generated updates if third-party providers (like OpenAI) experience downtime, though this will not affect your access to previously stored course materials.

6. User Conduct

You agree not to:

• Share your login credentials with others.
• Reproduce, redistribute, or pirate any content from our platform.

We reserve the right to terminate your account without refund if you violate these rules.

7. User Content (Your Notes)

The Services allow you to create and store personal notes ("User Content"). You retain full ownership of your User Content. You grant us a limited license to store and display this content solely for your use of the Services. While we use secure providers (Google Firebase), we are not responsible for any loss of your notes due to technical failures. We recommend keeping your own backups.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AI Academy shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits) arising from your use of the Services. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Serbia.

• Consumer Protection: If you are a consumer resident in the EEA or UK, you may also benefit from mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
• Disputes: Any disputes shall be subject to the non-exclusive jurisdiction of the courts in Belgrade, Serbia.
